LAHORE: The Supreme Court Bar Association (SCBA) on Saturday moved a petition before the apex court against the election of ex-PM Nawaz Sharif as president of the Pakistan Muslim League-Nawaz (PML-N) and against the sections 203 and 232 of the Election Act, 2017.
SCBA Secretary Aftab Ahmad Bajwa filed the petition before the Lahore Registry of the Supreme Court of Pakistan. The respondents in the petition are: federation of Pakistan through the Law secretary; the Election Commission of Pakistan; the PML-N through its secretary; Mian Muhammad Nawaz Sharif; the Senate secretary; and the National Assembly secretary.
Petitioner’s counsel Muhammad Azhar Siddique stated that the impugned act was only to facilitate Nawaz Sharif to head his political party despite disqualification in Panama Papers case. He stated that disqualification under Article 62 and 63 of the Constitution could not be overtaken by sub-constitutional law. “A person who cannot become a parliamentarian due to operation of constitutional law, he surely cannot become head or office-bearer of a political party,” he said.
